Supreme Court Case Could Affect the Future of DVR Program Sharing

MGM vs. Grockster is going to the supreme court, and its outcome could affect the freedom of DVR manufacturers to innovate and your future ability to share programs.

At issue in the Grokster case is a legal standard set by the Supreme Court in 1984 when it ruled that creators of the Sony Betamax VCR and other new technologies could not be held liable for acts of copyright infringement so long as a device is capable of substantial legitimate uses.

"Betamax and the principles that Betamax represents brought legal clarity to the technology industry 20 years ago," said Michael Petricone, vice president of technology policy for the Consumer Electronics Association. "That gave the technology industry the license to go out and innovate without having to ask the content industry permission first."
